These Terms of Service ("Terms") govern your use of SanctionKit's cryptocurrency sanctions screening services. By using our services, you agree to these Terms.

1. Definitions

• "Service" means the SanctionKit API, dashboard, MCP server, and related services
• "Customer" means the individual or entity using the Service
• "API" means our application programming interface for sanctions screening
• "Credits" means the unit of measurement for API usage
• "Sanctioned Address" means a cryptocurrency address appearing on official sanctions lists
• "Documentation" means our API documentation and integration guides

2. Service Description

2.1 What We Provide

SanctionKit provides:

• Real-time cryptocurrency address screening against sanctions lists (OFAC, EU, UK)
• RESTful API for automated screening
• Dashboard for manual checks and API management
• MCP server for AI agent integration
• Downloadable sanctions dataset for on-premise use (select plans)

2.2 What We Don't Provide

SanctionKit does NOT provide:

• Legal, compliance, or regulatory advice
• Guarantee of regulatory compliance
• Risk scoring or transaction monitoring
• Know Your Customer (KYC) services
• Blockchain analytics beyond sanctions screening

3. Account Terms

3.1 Registration

• You must provide accurate and complete information
• You must be legally capable of entering contracts
• You may not use the Service if you are subject to sanctions

3.2 Account Security

• You are responsible for maintaining API key confidentiality
• You must notify us immediately of any unauthorized use
• We are not liable for losses from compromised credentials

4. Usage Restrictions

4.1 Prohibited Uses

You may NOT:

• Use the Service for illegal purposes or to facilitate illegal activities
• Violate any sanctions laws or regulations
• Reverse engineer or attempt to derive our sanctions data sources
• Scrape, cache, or store sanctions data beyond authorized use
• Resell or redistribute the Service without authorization
• Circumvent rate limits or access restrictions
• Introduce malware or compromise security
• Misrepresent your identity or authorization

4.2 Rate Limits

• API calls are subject to rate limits based on your plan
• Excessive usage may result in temporary throttling
• Repeated violations may result in suspension

5. Payment Terms

5.1 Pricing

• Prices are as listed on our pricing page
• Free trial includes 300 credits with no time expiration
• Paid plans are billed monthly in advance

5.2 Credits and Overages

• 1 credit = 1 unique address check via /screen endpoint
• Duplicate addresses in batch calls consume only 1 credit
• Startup plan: $0.002/credit after 20k, capped at $100
• Scaleup plan: $0.001/credit with no cap

5.3 Billing

• Payment is processed via Polar
• All fees are non-refundable except as required by law
• You are responsible for all applicable taxes

6. Data and Privacy

6.1 Data Processing

• We do not store addresses you submit for screening
• Queries are processed in-memory and immediately discarded
• We log only aggregate usage metrics
• All API traffic is encrypted via HTTPS

6.2 Your Data

• You retain all rights to your data
• You warrant that you have rights to submit addresses for screening
• You are responsible for compliance with data protection laws

7. Intellectual Property

• SanctionKit retains all rights to the Service and its technology
• You receive a limited license to use the Service per these Terms
• You may use screening results for your internal business purposes
• You grant us rights to use feedback for service improvement

8. Disclaimers and Limitations

8.1 Service Availability

• We target 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance with reasonable notice
• We are not liable for third-party service interruptions

8.2 Accuracy Disclaimer

THE SERVICE IS PROVIDED "AS IS". WE DO NOT WARRANT THAT:

• The Service will meet all your requirements
• Results will be 100% accurate or complete
• The Service ensures regulatory compliance
• Sanctions lists are updated in real-time

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to fees paid in the prior 12 months
• We are not liable for indirect, consequential, or punitive damages
• We are not liable for your compliance failures or regulatory penalties

9. Compliance and Sanctions

• You represent that you are not subject to sanctions
• You will comply with all applicable sanctions laws
• You acknowledge that compliance is ultimately your responsibility
• We may suspend service immediately for suspected violations

10. Indemnification

You agree to indemnify and hold SanctionKit harmless from claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your infringement of any third-party rights

11. Termination

11.1 Termination by You

• You may cancel your account at any time via the dashboard
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months

11.2 Termination by Us

We may suspend or terminate your account for:

• Violation of these Terms
• Suspected illegal activity or sanctions violations
• Non-payment
• Extended inactivity

12. General Provisions

12.1 Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

12.2 Dispute Resolution

• We encourage resolution through good faith negotiation
• If necessary, disputes will be resolved through binding arbitration
• Small claims court remains available for qualifying claims

12.3 Changes to Terms

• We may update these Terms with 30 days notice
• Continued use constitutes acceptance of new Terms
• Material changes will be communicated via email

12.4 Miscellaneous

• These Terms constitute the entire agreement
• If any provision is unenforceable, others remain in effect
• Our failure to enforce rights is not a waiver
• You may not assign these Terms without our consent
